Privacy policy & terms
Effective October 13, 2026 · Governing jurisdiction: Orange County, California
By engaging with Verral Media, paying an invoice, or utilizing our custom-built web assets and advertising campaigns, you (the "Client") agree strictly and unconditionally to the following Terms of Service and Privacy Policy.
Part I: Terms of Service & Liability Waiver
1. Aesthetic & creative waiver (the "Subjective Preference" clause)
Verral Media provides custom web design, AI-generated video creatives, and marketing assets. The Client acknowledges that design is strictly subjective. The Client explicitly waives any right to dispute, withhold payment, request refunds, or initiate legal action based on subjective aesthetic preferences. This includes, but is not limited to, disagreements over website color palettes, typography, AI-generated video artifacts, layout structures, or copywriting tone. All assets are provided "AS IS."
2. Platform dependency & uptime
Verral Media utilizes third-party infrastructure, including Cloudflare for web hosting, Meta Platforms (Facebook/Instagram) for ad distribution, and Stripe for payment processing. Verral Media assumes zero liability for downtime, suspension, account bans, ad-account restrictions, or algorithmic changes executed by these third-party platforms. If Meta rejects a video creative or restricts a campaign, Verral Media is not liable for lost potential revenue.
3. Performance guarantees & limitation of liability
While Verral Media guarantees the delivery of localized ad impressions (e.g., 25,000 local impressions), we do not guarantee specific financial returns, lead conversion rates, or closed contracts. The Client operates in the trades industry (tree service, pressure washing, etc.) and is solely responsible for closing their own leads.
Under no circumstances shall Verral Media, its founders, operators, or affiliates be held liable for any direct, indirect, incidental, or consequential damages (including lost profits or business interruption). In the event of any legally validated claim, Verral Media's total aggregate liability shall never exceed the total amount paid by the Client to Verral Media in the thirty (30) days preceding the claim.
4. Indemnification
The Client agrees to indemnify and hold harmless Verral Media from any lawsuits, fines, or damages arising from the Client's actual business operations. If a consumer sues the Client over a poorly executed pressure washing job or property damage from a tree removal, the Client assumes 100% of the legal and financial responsibility.
5. Billing & refunds
All retainer fees (including initial pilot discounts) are non-refundable. Verral Media allocates capital immediately toward third-party ad spend (Meta Ads) and asset generation upon receipt of payment. Chargebacks filed through Stripe or credit card issuers will be aggressively contested using this agreement, and the Client's web assets and ad campaigns will be instantly terminated.
Part II: Privacy Policy
1. Information we collect
To execute our lead-generation services, we collect necessary business information, including but not limited to: business names, authorized representative names, phone numbers, email addresses, and service radii.
2. Payment data
Verral Media does not view, store, or host your credit card information. All payments are processed securely through our verified third-party payment gateway (Stripe, Inc.). Your payment data is subject to Stripe's independent privacy and security policies.
3. How we use your data
Your data is used exclusively to:
- Build, host, and maintain your custom lead-generation landing pages.
- Configure and target local demographics within the Meta Ads Manager.
- Communicate with you regarding campaign performance, lead distribution, and billing.
4. Data sharing & third parties
We do not sell your personal or business data to data brokers. We only share your data with the essential third-party infrastructure required to run your campaigns:
- Meta Platforms, Inc. (to run targeted local ads)
- Cloudflare, Inc. (to host your custom websites)
- Stripe, Inc. (to process your retainer payments)
5. Consumer lead data
Any consumer data (leads) generated through Verral Media's ad campaigns is passed directly to the Client. The Client assumes full responsibility for complying with all local, state, and federal telemarketing and privacy laws (including the TCPA) when contacting these leads.
